Do Both Husband and Wife Need to Complete a KYC Form When Selling a Property in Jamaica?

Yes, under Jamaica’s Real Estate (Dealers and Developers) Act (REDDA) and the Proceeds of Crime Act (POCA), both husband and wife must complete a Know Your Client (KYC) form if they are joint owners of the property.

Why?

  1. Joint Ownership: If both names are on the title, both individuals are considered legal owners and must be verified.

  2. Anti-Money Laundering (AML) Compliance: POCA requires that all beneficial owners of a property be properly identified to prevent illicit transactions.
