A Jamaican countryside landscape with a winding dirt road, dominated by the lush green hills of the Blue Mountains, serving as the servient estate, while a nearby rustic wooden gate marks the boundary of the dominant estate, a rural property with a picturesque stone cottage, surrounded by vibrant tropical flowers and towering palm trees, bathed in the warm, golden light of the late afternoon sun, with a hint of mist rising from the valley below,

An easement appurtenant is a legal right that benefits a specific parcel of land, known as the dominant estate, by granting it access or usage privileges over an adjacent parcel, known as the servient estate. In Jamaica, this type of easement is often utilized to provide access routes, utility services, or other essential functions that enhance the usability of the dominant estate. The easement appurtenant runs with the land, meaning it remains in effect even if the property ownership changes, and it is integral to the property’s value and functionality. Globally, easements appurtenant are crucial in real estate transactions and land development, facilitating access and resource use while clearly defining the rights and responsibilities of both property owners. This legal arrangement helps resolve property access issues, supports land development, and maintains property value by ensuring that essential services and pathways are preserved and legally enforceable.
