How to Properly Complete a Notice to Quit?

  1. Service of Notice: Personally serve the notice to quit on the tenant and keep a copy for your records.

  2. Reasons for Quitting: The notice must include a valid reason for why the premises are required to be vacated. Valid reasons may include:

    • Non-payment of rent for 30 days or more.

    • Landlord’s own residence.

    • Dependent’s residence.

    • Major repairs needed.

    • Improvement or rebuilding purposes.

  3. Notice Period: For residential premises, the notice should provide at least one full rental month’s notice, expiring the day before the next rent month begins. For example, if rent is due on the first of the month, the notice must be served before the 30th or 31st of the current month to expire by the 30th or 31st of the next month.

  4. Lease Agreement: If there is a written lease, the notice period must adhere to the terms stated in the lease agreement. However, for commercial premises, the notice period is typically the same as for residential properties, but there may be exceptions.
