Rescission in real estate

Rescission in real estate is the legal process of canceling a contract and returning both parties to their original positions. This typically occurs when the contract is found to have been based on misrepresentation or fraud. In Jamaica, if a buyer discovers significant falsehoods about a property after a sale, rescission can void the contract and return any payments made. Similarly, globally, rescission allows for the annulment of contracts tainted by significant errors or deceit. For instance, if it’s revealed that a property’s condition was grossly misrepresented, rescission provides a means to cancel the deal and recover funds, ensuring fairness in real estate transactions.
