Tenancy by the entirety is a form of property ownership exclusive to married couples, where both spouses hold an undivided interest in the entire property as a single legal entity. This arrangement includes the right of survivorship, meaning that if one spouse passes away, the surviving spouse automatically inherits the deceased’s share, ensuring that the property remains wholly owned by the surviving partner. This type of ownership requires that both spouses be married at the time the property is acquired and is automatically terminated if one spouse dies, if the couple divorces, or if both spouses mutually agree to end it. Tenancy by the entirety provides legal benefits, as it allows each spouse to possess the whole estate rather than just half, and prevents creditors of one spouse from placing liens on the property.
